When a person dies with assets owned solely in their name, without a named joint owner or designated payable-on-death beneficiary, probate may be required to transfer the asset to the deceased person’s beneficiaries. Additionally, if the deceased was the grantor of a trust, Sonya can help the trustee understand their legal duties and assist with administering the trust through to the distribution of the trust assets to the beneficiaries. Sonya also assists beneficiaries to understand their rights and what to expect as a trust beneficiary.
This type of Administration is a simplified Probate process. Generally, this is used for smaller estates; creditors are barred from claims against the estate and if the decedent has passed over two years ago.
This type of process is used for larger estates and will require an appointment of a Personal Representative. Not everyone can serve in this capacity and can discuss the qualifications required.
If the decedent has set up a trust and it has been funded, a Trust Administration will be required. We will have to determine if all the assets were in Trust, otherwise, it is possible to require a Probate even when a Trust has been established and funded.
